1. Introduction

These Terms of Service ("Terms") govern your use of the TrainKit platform operated by TrainKit ("we", "us", or "our"), accessible at trainkit.co.uk and associated subdomains. By accessing or using our platform, including the student portal and any training centre websites hosted through our service, you agree to be bound by these Terms.

2. About the Platform

TrainKit is a software platform that enables training centres to manage their courses, bookings, and student certifications. The platform provides:

  • Public-facing websites for training centres
  • Online course booking and payment processing
  • A student portal for accessing certifications and booking history
  • Administrative tools for training centre operators

3. Student Accounts

Student accounts are automatically created when you book a training course through the platform. Login credentials are sent to the email address provided during booking. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Providing accurate and up-to-date personal information
  • Notifying us immediately of any unauthorised use of your account

4. Bookings and Payments

When you book a training course through the platform:

  • Your booking is with the training centre directly, not with TrainKit
  • Payments are processed securely via Stripe, our third-party payment provider
  • Course prices, availability, and schedules are set by the individual training centres
  • You may be offered the option to pay in full or pay a deposit at the time of booking
  • All prices are displayed in GBP and include VAT where applicable

5. Cancellations and Refunds

Cancellation and refund policies are determined by each training centre. Please contact the training centre directly for information about their specific cancellation policy. TrainKit is not responsible for processing refunds — these are handled by the training centre that provided the course.

6. Certifications

Certifications and certificates accessed through the student portal are issued by the relevant training centres. TrainKit provides a digital platform for storing and accessing these documents but does not issue, validate, or guarantee any certifications. The accuracy and validity of certifications are the responsibility of the issuing training centre.

7. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the platform
  • Interfere with or disrupt the platform or its servers
  • Submit false or misleading information
  • Use another person's account without their permission
  • Attempt to reverse-engineer or copy any part of the platform

8. Artificial Intelligence and Machine Learning Prohibition

⚠️ Explicit AI Training Prohibition

Strictly Prohibited: The use of any content, data, code, interface designs, business logic, algorithms, or any other materials from the TrainKit platform for the purpose of training, developing, improving, or testing artificial intelligence systems, machine learning models, large language models (LLMs), or any automated decision-making systems is expressly prohibited without explicit written authorization from TrainKit.

This prohibition specifically includes but is not limited to:

  • Training AI models, neural networks, or machine learning algorithms on our platform content
  • Using our data to create training datasets for AI systems
  • Incorporating our platform structure, workflows, or user interfaces into AI-generated outputs
  • Feeding our content into chatbots, AI assistants, or automated tools
  • Using our platform as a benchmark or reference for AI development
  • Creating derivative AI models based on analysis of our platform

Legal Consequences: Violation of this provision constitutes a material breach of these Terms and may result in immediate termination of access, legal action for copyright infringement, breach of trade secret protections, and damages including but not limited to statutory damages, actual damages, and legal costs.

9. Web Scraping and Data Mining Prohibition

Automated Access Prohibited: The use of bots, scrapers, crawlers, spiders, or any automated tools to access, extract, copy, monitor, or collect information from the TrainKit platform is strictly prohibited unless explicitly authorized in writing.

Prohibited activities include:

  • Scraping course information, pricing data, or availability details
  • Extracting student testimonials, success stories, or user-generated content
  • Copying website structure, design elements, or user interface components
  • Harvesting email addresses or contact information
  • Automated monitoring of platform changes or updates
  • Systematic downloading of pages, images, or documents
  • Using headless browsers or automation tools (Selenium, Puppeteer, etc.) to access the platform
  • Circumventing robots.txt directives or technical access controls

Technical Measures: We employ technical measures to detect and prevent unauthorized automated access. Attempts to circumvent these measures may constitute a violation of the Computer Misuse Act 1990 and other applicable laws.

10. API Access and Integration Restrictions

No Unauthorized API Access: Access to TrainKit's APIs, internal endpoints, or backend services is strictly limited to authorized integrations only. Any unauthorized access attempts are prohibited and will be treated as a security breach.

The following are explicitly prohibited:

  • Reverse engineering of API endpoints or request structures
  • Accessing undocumented APIs or internal services
  • Creating unauthorized integrations or third-party applications
  • Bypassing authentication or authorization mechanisms
  • Rate limit circumvention or distributed access attempts
  • Sharing API credentials or access tokens with unauthorized parties

11. Competitor Use Restrictions

Competitive Intelligence Prohibition: Use of the TrainKit platform by direct competitors or for competitive analysis purposes is strictly prohibited without express written permission.

Specifically prohibited competitor activities include:

  • Accessing the platform to analyze features, functionality, or workflows for competitive purposes
  • Copying or replicating platform features, user interfaces, or business processes
  • Using our platform to benchmark or compare against competing products
  • Creating similar or derivative products based on observation of our platform
  • Taking screenshots, recordings, or documentation for competitive intelligence
  • Recruiting or attempting to recruit our customers, training centre partners, or employees

Definition of Competitor: A competitor is any individual or organization that develops, markets, or provides software platforms, booking systems, learning management systems, or related services for training centres, educational institutions, or course providers that could be considered competitive with or substitute for TrainKit's services.

12. Intellectual Property

The TrainKit platform, including its design, features, and content (excluding content provided by training centres), is owned by TrainKit and protected by intellectual property laws. Training centre logos, branding, and course content belong to their respective owners.

13. Limitation of Liability

TrainKit provides the platform on an "as is" basis. To the fullest extent permitted by law:

  • We do not guarantee uninterrupted or error-free access to the platform
  • We are not liable for the quality, safety, or content of training courses
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid through the platform in the preceding 12 months

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

14. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you by updating the date at the top of this page. Your continued use of the platform after changes are posted constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
